7. Client Data Confidentiality & AI Ethics
7.1 Confidential Information
In the course of providing Fractional Leadership and Marketing Automation Services, we may gain access to confidential, proprietary, or non-public information relating to your business, including business strategies, operational processes, internal documentation, customer or partner information, and commercial workflows ("Confidential Information"). We agree to maintain the confidentiality of such information and will not disclose it to any third party except as required to perform the Services, with your prior written consent, or as required by law.
7.2 Use of Client Data in AI-Enabled Systems
When implementing or advising on AI-enabled tools, automations, or workflows:
- No Cross-Client Model Training: Client data is not used to train shared, public, or communal AI models in a manner that would allow other parties to access or infer client-specific information.
- Controlled Processing Environments: Client data is processed only within tools, platforms, or environments approved by the client, and is handled using privacy-conscious and security-aware configuration practices.
- Data Ownership: The client retains full ownership of all data provided to us and of all client-specific strategic outputs, workflows, and configurations developed specifically for the client as part of a paid engagement.
- Client Review Responsibility: AI-generated outputs are provided as decision-support tools only. The client is responsible for reviewing, validating, and approving all outputs prior to operational, commercial, or regulatory use.
7.3 Regulated and GxP-Related Information
Unless expressly agreed in writing, we do not access, process, or store regulated GxP production data, batch records, validated system data, or data generated from live manufacturing execution, quality, or control systems. Our Services are advisory and strategic in nature and do not replace client responsibilities for regulatory compliance, system validation, or quality oversight.
7.4 Third-Party Platforms
Certain Services involve the configuration or integration of third-party tools (including but not limited to n8n, Zapier, Make, OpenAI, Anthropic, or HubSpot). Use of such platforms is subject to their respective terms of service and privacy policies. We are not responsible for security incidents originating within third-party platforms.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to conflict of law principles.
